Terms of service

By accessing or using the Service, you agree to be bound by these Terms and by our Privacy policy. If you do not agree, do not use the Service. If you are using the Service for an organization, you represent that you are authorized to accept these Terms on its behalf.

• Operator means a property management business or individual that holds an account.
• Authorized user means a person an operator invites, such as an admin, manager, or technician.
• Tenant means a resident or occupant who submits a maintenance request.
• Customer data means the information operators and their users submit to the Service.

PropFix provides software that helps operators receive maintenance requests, assign work, track status, and view analytics. The Service is a software tool. It does not perform repairs, does not provide property management, and does not provide legal, financial, or professional advice, and it does not guarantee any particular outcome. Operators remain responsible for their own operations and decisions.

• You must be at least 16 years old to use the Service.
• You agree to provide accurate information and to keep it current.
• You are responsible for activity that happens under your account and for keeping your credentials secure.
• You must notify us promptly at support@propfix.io if you suspect unauthorized use of your account.

• Use the Service only for lawful property maintenance purposes.
• Obtain any consents you need from your tenants and team before submitting their information.
• Ensure your use complies with the laws that apply to you, including data protection and housing laws.
• Keep your contact and billing information current.

You agree not to:

• Attempt to access another company's data or any account that is not yours.
• Reverse engineer, copy, or create derivative works from the Service, except where the law permits.
• Interfere with or disrupt the Service, including by overloading or probing it.
• Use the Service to send spam, to harass, or to engage in fraud or any illegal activity.
• Upload malicious code or content that infringes the rights of others.

Tenants and users may submit descriptions, photographs, and other content. You are responsible for the content submitted through your account and for ensuring you have the right to submit it. You grant PropFix a limited license to host, store, and process this content solely to provide the Service.

• We offer a free trial that does not require a credit card. The trial length is shown when you sign up.
• After any trial, paid plans are billed in advance on a monthly or yearly basis through our payment processor.
• Subscriptions renew automatically for the same period unless you cancel before the renewal date.
• You can cancel at any time from your billing settings. Cancellation stops future charges and takes effect at the end of the current billing period.
• We offer a refund within 14 days of your first payment if you are not satisfied. Renewal payments are not refundable except where required by law.
• Prices may change. We will give you advance notice of any price change, and it will take effect at your next renewal.
• You are responsible for any taxes that apply to your purchase.

As between you and PropFix, you own your Customer data. You grant us a limited, nonexclusive license to use Customer data only to provide, secure, and improve the Service and as otherwise described in our Privacy policy. You can export or request deletion of your data as described there.

PropFix and its licensors own the Service, including its software, design, brand, and logos. These Terms do not transfer any of our intellectual property to you. You may not use our name or logos without our written permission. We welcome feedback, and if you give it, you agree we may use it without obligation to you.

The Service relies on providers such as authentication, payment, hosting, storage, and email services. Your use of the Service may also be subject to those providers' terms. We are not responsible for third party services that we do not control.

We work to keep the Service available and reliable, but we do not guarantee uninterrupted access. Free trials and entry plans are provided without an uptime commitment. Higher tier plans may include specific availability commitments, which we will describe in a separate agreement or order. We may perform maintenance and update the Service from time to time.

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and noninfringement, to the maximum extent permitted by law. PropFix does not warrant that the Service will be error free or that defects will be corrected. Any information or output from the Service is for operational use only and is not professional advice.

To the maximum extent permitted by law, PropFix and its officers, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising from or related to your use of the Service. Our total liability for any claim arising from or related to the Service will not exceed the greater of the amount you paid to PropFix in the 12 months before the event giving rise to the claim, or one hundred US dollars.

You agree to indemnify and defend PropFix against claims, damages, and costs, including reasonable legal fees, arising from your misuse of the Service, your violation of these Terms, your Customer data, or your violation of any law or the rights of a third party, including your tenants. This obligation is subject to the limitation of liability above.

You may close your account at any time. We may suspend or terminate your access if you violate these Terms, fail to pay, or use the Service in a way that risks harm to others or to the Service. When an account is closed, we will delete or return your Customer data within a reasonable period, unless we must keep it to meet legal obligations. Sections that by their nature should survive termination will continue to apply, including ownership, disclaimers, limitation of liability, and indemnification.

We may update these Terms from time to time. If we make material changes, we will post the updated Terms here, update the date above, and where appropriate give you at least 15 days notice before they take effect. By continuing to use the Service after the changes take effect, you accept the updated Terms.

These Terms are governed by the laws of the United Arab Emirates, without regard to conflict of law rules. You agree that the courts located in the United Arab Emirates will have jurisdiction over any dispute arising from or related to these Terms or the Service, and you consent to their jurisdiction. Before bringing a claim, you agree to first contact us at legal@propfix.io so we can try to resolve the matter in good faith.

• Entire agreement: these Terms and our Privacy policy are the entire agreement between you and PropFix regarding the Service.
• Severability: if any part of these Terms is found unenforceable, the rest remains in effect.
• No waiver: our failure to enforce a provision is not a waiver of it.
• Assignment: you may not assign these Terms without our consent. We may assign them in connection with a merger, acquisition, or sale of assets.
• Force majeure: we are not liable for delays or failures caused by events beyond our reasonable control.
• Notices: we may send notices to the email on your account. You can reach us at the addresses below.
